At pre-race inspection at Daytona, Robby Gordon's Dodge Charger was found to have an unapproved nose. Since NASCAR has already established that COT infractions carry the fine of 100 points, $100,000 in fines, and a six-race suspension of the crew chief, that is the punishment which was handed down. Since that time, many have come to Gordon's defense, stating that this penalty is far too harsh and should be reduced.
For far too long, NASCAR had no set amount of punishment for teams found with unfair advantages - it is an issue that has been rectified over the last year, as each team found in violation of the rulebook was given the same punishment time and time again. In fact, four teams come to mind that received this penalty in 2007 - Hendrick teams #24 and #48, DEI team #8, and Michael Waltrip team #55. That is the black and white of the case and the NASCAR officials followed the letter of their law.
Since I believe that every situation has a little grey in it, let's take a look at the grey of this case. Gordon had just changed over from Ford to Dodge. Apparently, they bought some parts from Evernham and the part number on the nose had an extra digit. Considering that they were not familiar with Dodge parts, they paid the extra digit no mind and put the nose on the car. With that being said, I do not think that is a big enough reason to overturn the established penalty for this kind of infraction. However, the next piece of grey just may be.
