First off, Mikey did not qualify for a DUI charge and almost doesn't count,......secondly, he passed the other two physical tests indicating sobriety....he was charged with failing to yield.....Not saying Mikey is a good driver off the track but I wonder if there was any other factors....such as sun partially blocking visability...or maybe another vehicle distraction.....not trying to make excuses for him, but it seems odd that the motorcycle driver "was not available for comment"......maybe he is hiding something.........
It really annoys me that the report says that alchohol was a factor........well sure it was.......but if you drink one small glass of wine at a Church function and drive home, then alchohol is a factor there too..

If you were Michael Waltrip and you sucked so bad that you couldn't drive your way out of a Coney Island Dodge'em - you would drink too.
Pretty soon one of his hot little daughters will be old enough to drive and then he can sit up in the booth with old DW and reminiscence about the good old days when all he had to worry about was how his hair was going to look after the race.

He did not qualify for a DWI but he did get a DUI. That means the officer on scene believed the alcohol played a factor in the accident.

Can't find my source on that info now. I think he was just charged with failure to yield but the police did say the alcohol was a factor in the accident.

That is what I said about it being a factor....one drink is a factor.......he was not drunk by the legal term.....(but definitely stupid)....and he only got charged with failing to yield........I read somewhere that the motorcycle driver had been drinking also....but that was not confirmed in the news reports.
