Phil Mickelson files suit against Yahoo Sports to find the source (poster) who defamed him. I'm glad he doesn't read FN ... or does he?

I don't know much of what goes on with the other threads (NFL, MLB, etc.) here on FN, but the NCAA threads seem (to me, anyway) to maintain some semblance of decorum where criticisms of sports figures are concerned. But maybe I'm wrong.

No you are right. NCAAF threads have some of the best posters with good football knowledge ... who actually discuss football most of the time.

The NFL threads is another story. There are only a few good posters over there ... most aren't concerned with football at all they're into slap-dicking each other and tossing insults. NBa - forget about it. Golf? zzzzzzzzz.

The exceptions are (for the most part) the posts of errant trolls, not the regulars. Aggravated posts from regulars are usually tinged with humor. Or, maybe I just think to well of the folks around here...

The sad thing is, people who post stupid imflametory crap on the net are usually cowards. They hide behind the monitor like a evil troll with a chaotic agenda!

I might also add that the mods here on FN do a fairly swift job of deleting comments and accounts if a blogger is over the top with his/her commentary. That self-censorship is probably essential to keep the legal eagles off their backs.

are you kidding me....this place is full of spam and dupes...The mods here have been inadequite for quite some time. They are aloof , lack personality and need to be replaced with people whom actually visit this site and comment.... I am talking to you Adam....red hat, I don't know where you went but you are the only one to ever respond to an FM! **** all this spam and site malfunctions...COME ON MAN!

We need Brotha's legal opinion on this, but as a public figure, I suspect Phil Mickelson probably doesn't enjoy extensive legal protection in instances of alleged libel and defamation of character, especially if his words and deeds are matters of public record. Any other barracks lawyers out there besides me?

An opinion is just an opinion is it not...I've seen someone use racial slurs and there was no lawsuit..they had the right to say any slurs they wanted to..Can I say Phill sucks..just wonder...

It's an opinion until it slanders someone. :)

Mickelson is indeed a public figure, but the defamation in this case met the Sullivan standard for defamation of public figures (reckless disregard of the truth). I doubt that the defendant is much of a deep pocket, but a suit would be welcome as it would make the point that you might wind up liable for posting outrageous defamatory falsehoods

Phil isn't going after the troll just because the troll was calling Phil a fat flatulent pig, an asshole, or a ****[Ity choker on the putting green. That type of stuff falls under opinion. There's no legal basis there for anything.

Phil's going after the troll because of the dozens of claims (that were presented as "facts") about Phil having an illegitimate kid out there, an unfaithful wife, and a massive gambling problem.
These are they types of things that could affect Phil's sponsorship dollars if the information started to spread in the golf community.
Going after the troll with a defammation suit sends a message to other fuckwit cowards out there that think they can get away with anything from behind a their keyboard.

I'm assuming that's sarcasm.
The mods on this site don't have the first clue about legal issues.
One of them even tries (on a regular basis) to solicit responses to private e-mail accounts despite many of the FN users being as young as 13.
