Did Harbaugh contact Smith, earn Niners a fine?

08:02 AM ET 03.24 | Jim Harbaugh, who is embracing the lockout's uncertainty ("I just love being in uncharted waters"), doesn't have many options at QB. One of the quarterback possibilities continues to be Alex Smith. Harbaugh's interaction with Smith -- remember, he admitted to Matt Maiocco in February that the two had met and tossed the ball around -- may have gotten the 49ers in a bit of hot water. On Wednesday, commissioner Roger Goodell reported that the league had fined five teams for having illegal contact with players prior to the lockout. The NFL did not reveal the teams, but there is speculation that the 49ers are one of the five. ... Given the 49ers' quarterback situation -- one player, David Carr, under contract -- Harbaugh had to get to know Smith to understand whether he was a plausible possibility should the labor situation grind into late summer.

Getting the players up on his system is the biggest problem he has, so eating a fine to get a headstart is kinda like taking a penalty to negate an opponent's touchdown: a good strategic foul.

Good time for Alex to be UFA. He is the same age as Kolb, has experience, better numbers and you do not have to give anything to get him.
Funny really, the 49ers need him more than he needs them , and Harbaugh knows it.
