Why Feds delayed Bonds indictment

Internal political considerations and concern among federal prosecutors that their case against baseball star Barry Bonds might not be strong enough delayed his perjury and obstruction of justice indictment for more than a year, according to a former FBI official familiar with the case. During that year, Bonds completed his last season with the San Francisco Giants without the threat of a suspension and overtook baseball legend Henry Aaron to set the home run record. What prompted prosecutors to finally proceed with the criminal case this week was not clear, but there was no indication of major breakthroughs or significant new evidence. "We pretty much were ready to go more than a year ago," said the former official, who spoke on condition of anonymity because the criminal case is pending. "The question was what would happen to someone's career if they took this case and didn't win it," the former official said. "They wanted assurances" they would win a conviction.

Could it also have been that someone didn't want to intercede during Bonds home run title hopes or upstage the entire 2007 baseball season if they did something during spring training or at some point in mid season? If all criminal cases were indicted on the gathering of additional evidence assuring a guilty verdict, the case log would be backed up worse than it is now.

It took so long because they had to figure out exactly how many times the guy lied to them under oath. No small number.

November 17, 2007  09:02 AM ET

the Feds have a 95 percent conviction rate

It is not the perception that MLB is totally drugged out and that most of it's major stars are juiced-up zombies.

More the idea that Bonds will be stoned by people who really do not understand the business of baseball.

The "feds" delayed everything so that the fallout would interfere with the free-agent process.

Call Sharpton and Jesse Jackson! It's gotta be racism! It's not that he lied under oath, or KNOWINGLY took steroids, or didn't show up on Capital Hill 2 years ago when he was invited (The were all granted immunity if they testified, that's why Palmeiro isn't going to jail), it's because THE WHITE MAN is after him. Oh and will someone finally tell Charles Barkley to shut the heck up!? All his little rants about race equal out to him being as ignorant as Dog the Bounty Hunter -

A few months at Club Fed, work on the memoirs, maybe throw together a movie deal, autographs for inmates.....he'll be the ish.

A lot of people I heard call in to sports radio shows aren't getting it about this indictment. MLB has NOTHING to do with this indictment or its timing. The Federal Government pursued this without concern for the time of the year or what Barry Bonds was about to accomplish during this past summer. This indictment IS NOT due to Bonds allegedly haven taken steroids. It is the about the Feds believing he LIED (perjury) about knowingly taking steroids - as in "I did not know I took something that was an illegal steroid". He is indicted for perjury and obstruction of justice NOT steroid use. This is something a lot of adults weren't understanding yesterday. My fifth graders in school yesterday were given a mini lesson about this yesterday and I think some of them understood this better than some of the idiots calling NYC sports radio.

By the way, for the record, I completely believe he is guilty of perjury (meaning also I believe he knowingly took steroids). I'm not too sure about obstruction of justice (any law experts here want to explain it better than the ESPN circus?).

But due to the wording of the indictment and Bonds' lawyers' comments so far, I believe they will take this to trial and Bonds will be found innocent, and walk away a free man, and even more arrogant than before.

If you want to keep exploiting the black athlete you are making serious mistakes. Payback is best served cold.

November 17, 2007  01:46 PM ET

Why is it a race issue when its a black athlete????
I dont care what color his skin is, if he is guilty send him to jail. If he is innocent, the accusers face the consequences.

November 17, 2007  02:08 PM ET

Is Britney Speas exploited because she is black too? People who play the race card are the ones keeping race an issue...

This has nothing to do with race and everything to do with the hole Barry has dug for himself. I don't want hear the "woe is me" comments from him now. Barry, you were a jerk to all but a very few people. Don't cry now when only those very few are there to support you during this time of need.

November 17, 2007  03:07 PM ET

lts a poor excuse for not indicting him earlier. Oh well then at least we all know that he will not escape justice this time.

November 17, 2007  03:26 PM ET

If the feds were really "after" bonds, they wouldn't have let him break the record. Nor would they have given Bonds a pass on that little meeting in front of Congress a few years ago. If Barry had nothing to hide, he wouldn't have gone to the extremes he has or gotten himself in the trouble he has. It doesn't matter what you think, if you are in front of a Grand Jury you tell the truth. That is why Barry is in trouble. As to whether someone else might be treated differently, no one else would have the audacity to think they can hide forever. Why hasn't Bonds tried to sue for Libel? Because he can't deny the words written about his deeds are the truth. Getting what he deserves, nothing more, nothing less. And, yes there are plenty of others deserving of some blame and punishment. They don't all deserve to be let off the hook, either. MLB and owners included.

This has nothing to do with his steriod use and everything to do with lying to a grand jury. Quit sticking up for the guy...he is a horrible person and has brought on himself everything he is getting.

<<< I'm not too sure about obstruction of justice >>>

The obstruction of justice charge is leveled because Bonds lies could have undermined the FEDS case against Victor Conte in the BALCO affair.

If it had gone to trial, and not been plea dealed out, then the defense could have used Barry's testimony to plant reasonable doubt on Conte's guilt. Thus obstructing justice.
