Report: Penn St. revokes Sandusky's retirement package

08:30 AM ET 07.17 | Jerry Sandusky's retirement package has been revoked. University spokesman Dave La Torre said the agreement was nixed following Sandusky's Nov. 5 arrest. La Torre added the university has no plans to recover a lump sum payment of $168,000.

True. This mainly affects Sandusky's wife, who was alleged to have been in the house while some of the atrocities occurred. If those allegations are true, I give some degree of props to PSU for this belated gesture.

???I???ve never seen anything as egregious as this in terms of overall conduct and behavior inside of a university,??? Emmert told Smiley about the situation at Penn State. ???I hope never to see it again. What the appropriate penalties are, if there are determinations of violations, we???ll have to decide???

???I don???t want to take anything off the table. The fact is, this is completely different than an impermissible benefits scandal that happened at SMU or anything else we???ve dealt with. This is as systemic a cultural problem as it is a football problem.

I was not aware that legally the university could withdraw a package where the employee had 100% vested rights. Even when terminated with cause, whatever is vested remains the right of the terminated employee. I would like to know how PSU can legally do what they did.
