08:22 AM ET 09.27 | Though in its early stages, a single lawsuit has the potential to affect a great deal of hockey. [The] lawsuit brought by the family of Derek Boogaard against the NHL players union could lead to some novel and tumultuous territory for the sport. ... The lawsuit, at its emotional heart, alleges that the Minnesota Wild and the Rangers, the two teams for which Boogaard served as a designated fighter, contributed to Boogaard's death. ... [The family's lawyer, Howard F. Silber], asked this week whether the lawsuit was motivated in part by a desire to obtain more information about Boogaard's treatment from the teams and the substance-abuse program, said: "That's a great question. At this point, this lawsuit is over the union's failure to uphold its duty to one of its members."

not that I don't feel for the guy's family...I cannot imagine what it's like to lose a sibling or worse, a child, no matter how olde. But at what point does personal responsiblity come into this? Did he come to these teams thinking he was going to be Henri Richard, and they forced him to be a fighter? He has been playing this role a long time

each individual chooses what they will or won't do.....doubt if force was ever involved....lot of players just say"That's how I choose to play the game"....some with finess, some more physical....some both....

Yeah thats pretty much sums it up...unfortunately there are many individuals in this world that don't like to accept responsiblity for their actions it is always someone else's fault

And that's why, once upon a time, the Easter Bunny, scattered eggs around the land of Ontario and lawyers emerged when they hatched. And everyone lived miserably ever after. The End.

And where were they (the family) while he was fighting and boozing, etc? Do they not take any responsibility?

What IF.....
the investigation uncovers that Hockey Management knew the risks better than previously thought and chose to do nothing for the player to help him cope/adapt/heal?
Then in my opinion the lawsuit would not be frivolous. Different opinion if it is merely a money grab

I don't understand the part about the player's union not upholding it's duty to one of it's members. Can anyone clarify?

Guys are missing the point since the article fails to fill you in on the reasons for the lawsuit. This article only focuses on the lawyer and his comments

I disagree. This is not about hiding the carcinogenic effects of something like cigarettes or asbestos. These are adults who know what they are doing, there is no hidden risk. Mr. or Mrs. Team Owner is paying you to beat people up, make sure no one beats your guy up, and maybe score a goal or two along the way. This is not news to anyone. But let's face it, all parties involved knew who and what they were. And as noted...where was all this concern when the drinking etc started?

I see that, but in point of fact there is, in my opinion, no basis for a lawsuit at all....
Again, a shame he is gone this young, and I truly feel sorry for the family....but...

Another difficulty I see is proving that his style of play was a direct cause of his death. A lot of assumptions are made that it is, yet most guys who are enforcers over the years have not had a problem. And, the stuff that went on in the 70's was a lot worse than today, so you would expect those guys to be worse off. Don't know if that's true.
Nobody expects…
