04:23 PM ET 10.23 | Oregon starting defensive tackle Isaac Remington has seen his DUI charge dropped, as he was just below the state's legal limit. He was suspended by coach Chip Kelly shortly after the arrest and missed playing against Arizona State. Kelly said at the time he was waiting for "clarification" on Remington's situation, so we should expect the DT to be on the field again soon.

So was the officer incompetent? He didn't know the requirement for a DUI? Something smells, and it's not just duck droppings.

You can still arrest for DUI even if they are under the legal limit at the discretion of the officer. That said, doesn't usually hold up in court. That's my guess as to what happened here.
