Junk fax lawsuit could cost Bucs $270 million

10:33 AM ET 06.22 | Gainesville business, exasperated by faxed ads for Buccaneers tickets several years ago, filed a lawsuit in U.S. District Court in Tampa earlier this week, alleging the football franchise violated a federal statute that outlaws "junk faxes." Because the lawsuit asserts that 180,000 people were sent such fax messages, the team could theoretically be liable for $90 million under the Junk Fax Prevention Act of 2005, which establishes a $500 fine for each unwanted fax. That figure could range as high as $270 million if the court determines that the faxes were "intentional," said Tampa attorney Michael Addison. Addison, who is representing Cin-Q Automobiles Inc. in the suit, said the business owner "was annoyed" by a fax in 2009 and sought out legal recourse. It is unclear whether the situation was aggravated by the Bucs' 3-13 record that year. In court papers, Addison asks a federal judge to certify Cin-Q's complaint as a class-action lawsuit. A previous suit was filed but withdrawn in Hillsborough Circuit Court.

Uh...if the allegations are true, the team broke the law, and are liable for the fines prescribed by that law. The lawyer is doing his job, representing his client.

A car dealer does not want junk faxes because they "annoyed" him but bulk junk mail ads from car dealers is OK. got it.

Agree with the principle, but a) junk mail isn't against the law, and b) junk mail doesn't cost you anything to receive...a fax does.

True enough. Now, how annoyed is one that it takes four years to act? What damages do you ask for? I assume the dealer saved all the faxes received, if not , then what? May be a lose lose where it costs more to pursue it than you ever get....

I remember when those anti-fax spam laws started going on the books. In Denver I recall a guy getting a judgement in the $10's of thousands. Don't know if he ever collected.

Flash forward 20 years and the law seems absurd. Back in the day of thermal paper it was a serious cost when you received a few of them a day.
