NFLPA will fight discipline of Incognito

06:51 AM ET 02.18 | As with so many of the twists and turns that involve Jonathan Martin and Richie Incognito, this new chapter comes with legal implications. The Collective Bargaining Agreement states that only one penalty may be imposed on a player. Article 46, Section 4 -- titled "One Penalty" -- says that there shall be only (duh) one penalty: "The Commissioner and a Club will not both discipline a player for the same act or conduct. The Commissioner's disciplinary action will preclude or supersede disciplinary action by any Club for the same act or conduct." Per a league source, the NFLPA intends to fight any discipline of Incognito based on Article 46, Section 4. The potential battleground comes from the question of whether the league would be disciplining Incognito for the "same act or conduct."

If the NFL and/or the Dolphins have penalized this dirtbag already, then the rule seems pretty clear. The Phins can try to trade him, or can just bite the bullet and cut him, but it's time for this circus to pack up it's tents and move along.

In any other corporation with 32 branch offices I'd say he never works again an Martin would be demoted to eternal mail room duty. But this is the NFL.

He's an idiot. He was in high school, in college and now in the NFL. Can he play? Sure. He has the IQ of a pet rock though and is more trouble than he's worth. Martin? A whiner. One punch in Richie's face and they would have been best friends. I wouldn't want either one on my team. More trouble than they're worth.

Well, my sources tell me he is a free agent this year regardless as his contract is up. He missed $470,000 in game checks from his suspension. I do not see this being a big deal at all. He will hit the free agent market and that is that.

I think Incog is getting screeeeeeeeewed. There has to be someone who really trashed him in the investigation other than Martin. Its not a he said he said but a he said and two others also said the same thing.

Absolutely. The terms of the CBA seem to say that if he's already been punished, he can't be punished again. Why protect the Phins from their stupid moves?
