Jefferson charged with assault

Nets forward Richard Jefferson was charged in a Minneapolis court Wednesday with choking a man who said Jefferson crashed his private birthday party in January. Jefferson was in Minneapolis for an N.B.A. game against the Timberwolves. The accusation came from Lyle Fox, who, according to a police report, said a hotel area had been roped off for the party. He said Jefferson entered the area, and when he was asked to leave, threw or pushed Fox onto a bench, grabbed him by the throat with both hands and began to choke him. On "The Mike and Murray Show" on satellite radio, ESPN reported, Jefferson gave a different version of events, saying that he had been approached by someone who was rude and disrespectful and that no punching or choking took place.

Why should there be two conflicting stories? Weren't there any witnesses?
If Jefferson was seen choking the man, then he should admit to doing so.
If no one saw him do anything of that sort, then it's the man's word versus Jefferson's, and it's likely that Jefferson is telling the truth (since it is likely that someone would have seen it if it had actually happened).
It's really that simple.
The existence - or non-existence - of witnesses basically swings the story one way or the other.

Fox: "umm, excuse me.....Mr. Jefferson, this is a private party, if you could please leave, we would greatly appreciate it?"
RJ: "why you little piece of ****, how dare you ask me to leave...do you know who I am, I'm Richard Jefferson"
Fox: "Oh my, I am truly sorry, but this is a private party, I don't want there to be any trouble"
RJ: "That's it!!.....I"m gonna kill you, you inconsiderate little prick"
Fox: "Help!!!...Why are you choking me???, somebody help me!!!"
