Attorney: Fulmer to fight subpoena
A lawyer for Phillip Fulmer says the Tennessee football coach will fight a subpoena seeking his sworn testimony in a suit filed by a former Alabama booster. Attorney Jeff Hagood said Tuesday he will seek to have the subpoena dismissed in Jackson County, where it was issued last week. Fulmer was served with the subpoena at Southeastern Conference Media Days in suburban Birmingham, creating a stir at the league's fall kickoff event. Hagood said he is fairly certain Fulmer has never met Smith. Fulmer accused the plaintiff's lawyers of serving the papers at last week's event to gain maximum media attention.

Of course he'll fight it. If nothing else, his lawyers will push to delay the actual deposition until after the Auburn game to minimize the publicity.

As a Bama fan, I would personally love to see all of this stuff fade into the past as it should be. However, if Fulmer's NCAA testimony was so altruistic and truthful then why should he have a problem going on the record with it in a court of law? He's not a defendant in the lawsuit. He played an integral role and has inside knowledge of the investigation which is vital to the case before the court. What exactly is Fulmer running from?

As a Tennessee fan, I too would love to see all this stuff fade in the past. I think the fans of both schools are over it however it is being kept alive by one lone booster who has been cut off by his school and is pretty ticked off.
