And his character of a person is in question due to the broken procedures for the sample. Anyone can see that. So again, how do you know nothing happened? Bc the same guy who was called upon to uphold the protocol, is the same one to fail it, says so?

I cannot tell what would happen in our legal system, I can only speculate. My feelings are the same if the result would have happen should a state or grand jury held this case.

Evidence tampering, I.e. Not following protocol would let this case go to a not guilty verdict. The same that this arbitration case has panned out. Record shows, not guilty. Or, innocent.

So what you're saying is you want to compare a "what if" to this actual event? Got ya. Sounds like a really plausible reason to compare scenarios.

Defending someone who was not banned for an illegal substance? I don't have to, he was already let off.

All I'm doing is supporting the fact that no one knows what happened in that 44 hours when the sample was where it shouldn't have been. How is it, this one sample fails to follow the procedures?

Says who? The guy in charge of the process of handling the sample. Hs character is already flawed by not following protocol.

Slander charge? Hope the guy filing will have enough money to pay for brains legal fees when he falls on his face for that ridiculous lawsuit.

Not really. Not depositing money into someone's account wouldn't lead to a "crime" being committed on their behalf.

Can you or anyone say for sure that the sample wasn't tampered with? Nd why his sample is the one, during all the samples processed that wasn't collard correctly?

Giving a breath sample gives you immediate results without the ability for anyone to tamper with those results. They also record in a state database as soon as their drivers license information is input into the intoxalizer machine. Either the person submits to a sample and then it is automatically recorded, or the test becomes a failure to submit if not given within a certain amount of time.

44 hours for a sample to sit in someones house is a far cry from a technicality. As for someone who handles samples as their job, they are fully aware of the procedures for it. To say you forgot to submit the sample is like saying I forgot I drank 5 beers before I drove.
