This is where I have to advocate for a "England-like" tort legal system. In England, in these sorts of suits, the loser pays (period). Meaning, if the fan loses the case, he has to pay the players legal expenses. If our system included a financial risk for people engaging in this sort of abuse of our legal system, this non-sense would go away. But lawyers and plaintiffs have nothing to lose. Ours is a 'nothing-ventured, nothing-gained' proposition. What's more (at the risk of soap-boxing), lawyers write laws, and are never going to change this system, because it makes them rich.
